Who Must Conduct a Risk Assessment?

According to the Occupational Health and Safety Act (ArbSchG), the accident prevention regulation „Principles of Prevention“ (BGV A1 or GUV-V A1), and §3 of the Operational Safety Ordinance (BetrSichV), all employers, regardless of the number of employees, are required to conduct a risk assessment.

  • § 5 para. 1 of the Occupational Health and Safety Act obligates the employer to carry out a risk assessment. This means that through an evaluation of the risks associated with employees‘ work, the employer must determine which occupational safety measures are necessary.
  • § 26 Criminal Offenses (BetrSichV) (1): Anyone who, through an intentional act as described in § 25 para. 1, endangers the life or health of an employee is liable to prosecution under § 26 No. 2 of the Occupational Health and Safety Act. This means that following an accident resulting in serious injury, the responsible public prosecutor will require the person in charge to present the risk assessment and provide written proof that employees were properly instructed.
